Anthropic Gives 5% of Itself to the Public. Musk Answers by Giving Away SpaceX Shares
Decrypt reports that Anthropic will commit 5% of its shares to a Public Benefit Fund, structured as a wholly owned LLC, subject to stockholder approval. About 20% of its stock would go to public causes once founder and employee pledges are counted. The article also covers Anthropic's draft AI safety bill, which lets the government block models risking over 50 deaths or $1 billion in damage, and Elon Musk's pledge of one SpaceX share per US child.
What it claims
Decrypt reported on October 19, 2026 that Anthropic will put 5% of its shares into a Public Benefit Fund, pending stockholder approval. Anthropic is preparing an IPO as soon as November 2026 at a reported valuation of about $2 trillion. At that price the 5% stake is worth about $100 billion on paper, in shares rather than cash. Anthropic has already committed $200 million to studying how to give, including "large donations to traditional nonprofits or direct distributions to specific populations." Two days before the fund announcement, Anthropic sent lawmakers a draft AI safety bill. The page gives more detail on that bill than the summary does.
How it works
The fund is a wholly owned LLC, not a nonprofit. Anthropic says this lets the fund switch between types of giving. The board can add another 2% of shares each time the company's value rises 50% above a baseline. Anthropic has not disclosed that baseline. None of the fund's equity can be used for lobbying or political donations. The 20% total counts the 5% fund, the co-founders' pledge to donate 80% of their equity, and a matching program for employee donations.
Under the draft bill, the government could block a model that poses a "foreseeable, imminent" risk of killing or seriously injuring more than 50 people, or of causing over $1 billion in damage. The bill names three routes to that harm: a bioweapon, an AI escaping human control, or a cyberattack. A block must go through the Commerce Department and needs a federal court order. Developers would have to publish safety frameworks and transparency reports for new models. Anthropic says the bill reflects its Advanced AI Framework, which it has promoted to lawmakers since June 2026.
Musk's pledge is one SpaceX share for each of about 72 million US children. At about $147 a share, that is about $10.5 billion, or just over 1% of his 6.42 billion shares as of June 30, 2026. Decrypt expects the shares to go through Trump Accounts, where donated stock is generally held for five years.
Limits
Anthropic has not said how the fund will be taxed or what it will disclose publicly. It says it will publish the fund's governance structure and valuation thresholds in the coming months. The bill is a draft shown to lawmakers, not a law. David Sacks, former White House AI czar, said on X that whether the LLC "serves the public good remains to be seen." Sam Altman accused Anthropic in April 2026 of fear-based marketing for Claude Mythos.
